A 28 year old man has been jailed for 18 years and 6 months for raping his nephew who was 9-years-old when the incident first occurred in 2014. The man was charged with 3 counts of rape.
While delivering the sentence, Suva High Court Judge Justice Riyaz Hamza reiterated society cannot condone any type of sexual assaults on children.
Juistice Hamza told the accused that as the uncle of the boy he should have protected the complainant, instead he has breached the trust of the boy.
The court also heard that a psychological assessment of the complainant pointed out that he had low IQ.
As the result of rape the complainant had experienced a traumatic life experience that has directly affected his mental health and caused damage.
Justice Hamza adds because of the incident the boy also suffers PTSD which causes panic attacks.
The man was 23-years-old at the time he raped the boy.
It was heard in court that the man is married and has 3 children.
In each of the three counts of rape, Justice Hamza set a sentence of 19 years and ordered that they be served concurrently.
Justice Hamza then considered the time spent in remand which is 6 months, leaving the time to serve as 18 years 6 months imprisonment.A non-parole period of 16 years 6 months imprisonment has been set.
