A man has been convicted of raping a 27-year-old woman living with mental disability.

The accused was a regular visitor to victim’s house as they were neighbours and he knew about the complainant’s mental disability.

Prior to the day the rape occurred, the man would go to the victim’s house for meals, he knew the victim lived with her older sister who also suffered from intellectual disability.

That day he drank kava at a house, then later went to the victim’s home, saw her with her sister and proceeded to rape her.

According to the assessors the accused knew that the complainant was suffering from mental impairment at the time of the act.

Justice Daniel Gounder in the High Court of Fiji at Labasa found the man guilty of rape.
