A 40-year-old father has been sentenced to 17 years imprisonment for raping, and indecently assaulting his daughter on four separate occasions.
The man was found guilty of indecently assaulting his daughter several times before raping her a year after the assaults started.
The father is convicted of first indecently assaulting his daughter in January 2015 when she was only nine years old.
He continued to do so – on three separate occassions until November the same year.
Between the months of January and November 2016, he raped her.
His daughter was 10-years-old at the time.
The Court heard that the acts were committed when the victim’s mother and her sisters were not at home.
A victim impact statement stated that when she thinks of the incident – the victim gets emotional, she experiences loss of concentration in school, has lost trust in people and becomes short tempered due to the effects of the incident.
The victim has isolated herself from everyone due to stress and pressure and on one occasion she had become suicidal.
In mitigation, defense counsel submitted to the Court that the man is a first offender, 40 years of age, father of four children, sole bread winner in the family, all his children are in primary school and his wife is sickly and not working.
Lautoka High Court Judge sentenced the perpetrator to 17 years 10 months and 15 days imprisonment with a non parole period of 16 years to be served before he is eligible for parole.
Due to the closeness of the relationship between the perpetrator and the victim, a permanent non-molestation and non-contact orders are issued to protect the victim under the Domestic Violence Act.
